Maryland sentencing courts may not throw away the key with respect to a drug offender whose three strikes include the violation of another state's drug laws, the Court of Special Appeals held yesterday.
While the intermediate appellate court affirmed Marvin Cantine's Baltimore circuit court conviction for conspiracy to possess heroin with the intent to distribute, it remanded his case for re- sentencing on the ground that a prior Virginia drug offense should not have counted as a sentence-enhancing strike.See the full content of this document
