Montgomery County's revised policy on distributing materials in public elementary schools unconstitutionally grants school officials unbounded discretion to determine which flyers may be included, the 4th U.S. Circuit Court of Appeals held yesterday.
The revised policy was adopted after the 4th Circuit reviewed the case in 2004, granting a preliminary injunction to the Child Evangelism Fellowship of Maryland Inc. - an organization that sought to use the flyers to promote its after-school Bible study classes.See the full content of this document
