Legislation that would prohibit individuals from suing under state law, unless the statute expressly permitted such suits, came under sharp and often sarcastic attack last week before the Senate Judicial Proceedings Committee.

Sen. Jamin B. "Jamie" Raskin, a committee member, led the barrage at Wednesday's session by pointing out that the U.S. Constitution -- with its individual rights and protections for criminal defendants - - contains no provision expressly permitting the people of the United States to sue if their rights are violated.
