Summary


Legislation to prevent abuse by those granted power of attorney drew support from advocates for older citizens but opposition from a delegate and trial attorney, who said the bill could actually protect negligent agents as long as they acted in good faith.

Naomi Karp of the AARP praised the proposed Maryland Power of Attorney Act, House Bill 852, saying it provides guidance and sets standards of care for individuals given the power to handle the business affairs of the elderly or infirm. Too often, she said, those given the power have abused it by converting their principals' money for their own use or exceeding their authority by making personal gifts of the principal's property.
