Maryland Court of Special Appeals: Contract Not Breached When Checks Lost

Summary


A creditor who loses a check presented to it for payment cannot successfully sue the debtor for breach of contract, the Court of Special Appeals has held.

While the debtor's obligation is not discharged, it is suspended until the bank declines to accept the check, the appellate court said.
